These Terms and Conditions set out:
the types and scope of services provided by electronic means by the Company through the Brokik Platform located at the website www.brokik.com
the rights and obligations of the Company and Users,
the conditions for the provision of services by electronic means by the Company,
the terms and rules of using the Platform,
the conditions for concluding and terminating contracts for the provision of services by electronic means,
the scope of use of intellectual property rights,
the scope of Property rental management
the possibilities of generating documents
In matters not regulated in these Terms and Conditions concerning the provision of services by electronic means, in particular the making of statements of intent in electronic form, the provisions of the Civil Code and other generally applicable laws shall apply.
The User is obliged to read the content of these Terms and Conditions before starting to use the Service.
These Terms and Conditions are made available to the User free of charge via the Platform prior to the conclusion of the Agreement by electronic means, in a manner that enables the User to obtain, reproduce, and record its content using the ICT system used by the User.
Upon acceptance of these Terms and Conditions and creation of an Account, an Agreement for the provision of services is concluded between the Company and the User.
The Company shall not be liable for the consequences of the User's use of the Platform in a manner contrary to these Terms and Conditions.
By accepting these Terms and Conditions, the User acknowledges and confirms that the Company does not act as a real estate intermediary within the meaning of the Act of 21 August 1997 on Real Estate Management.
The Appendices, i.e. the Privacy Policy and the Price List, also form an integral part of the Agreement. In certain cases described in these Terms and Conditions, a User who is a personal data controller within the meaning of the GDPR is also required to enter into a data processing agreement.
§ 3 Registration
Registration on the Platform is voluntary and free of charge.
Use of the Platform by the Tenant is free of charge – in full and for an unlimited period. The Tenant never bears any fees for using the Platform, and a failure to pay the Subscription by the Landlord does not limit the Tenant's rights.
Also free of charge, for an unlimited period and without the need to conclude a paid agreement, are: the creation and holding of an Account, the use of document generators, the reliability profile, and reports made available by the Company as free services, to the extent indicated in the Price List in each case. Moving a Service that has so far been free of charge to the paid Services requires an amendment to these Terms and Conditions under the rules of § 15 and does not apply to Landlords during a paid Billing Period.
Management of an ongoing Property lease by the Landlord is a paid service. The Landlord gains access to it after purchasing a Subscription in accordance with the Price List. Without payment of the Subscription, the Landlord's Account is in a state of Restricted Access.
The User gains the ability to use the Brokik Platform after completing the registration form available at www.brokik.com, confirming the verification e-mail, and accepting these Terms and Conditions.
Registration results in the creation of a User Account on the terms set out in these Terms and Conditions.
A condition for obtaining User status is the correct completion of the free registration process, during which the future User provides the personal data required for the Account registration process (first name, surname, login, e-mail address) and accepts the content of the Terms and Conditions and the Privacy Policy, and, where the Landlord is a personal data controller, enters into a data processing agreement. Depending on the scope of functionalities used, it may prove necessary to provide the company name, NIP (Tax ID) number, telephone number, and address.
By accepting these Terms and Conditions, the User declares that:
they have read the Terms and Conditions, understood their content, and accept them, and undertake to comply with the Terms and Conditions,
they undertake to provide true data and information consistent with the actual and legal state of affairs,
they understand that they bear legal responsibility for any data and information entered on their Account and for any actions performed through the Portal.
Upon the correct completion of the registration process and confirmation of the correctness of the e-mail address by clicking on the verification e-mail, the User Account is created.
The service provided by the Company consists in enabling, through the Brokik Platform, the management of the Landlord's Property lease, communication with the Tenant, and the generation of documents.
Users of the Brokik Platform may be both legal persons and adult natural persons performing a legal act either related or not directly related to their business or professional activity
A User may be registered both as a Landlord and as a Tenant, however in that case it is necessary to create two separate User accounts on the Brokik Platform.
Activation of paid Services under the Subscription occurs upon payment. Failure to make payment does not result in deletion of the Account or loss of the data entered – the Account moves into a state of Restricted Access on the terms set out in § 10, subject to § 10b (deletion of an Inactive Account).
The Company reserves the right to refuse to provide the Service to selected Users in the event of a repeated attempt to register a User account by a User whose Agreement was terminated by the Company under § 7(3) of these Terms and Conditions. In the event of refusal to conclude the agreement, the User will not be charged any fees.
§ 4 User Panel
When registering on the Brokik Platform, the User chooses whether to register as a Landlord or as a Tenant
The User obtains access to their account by providing a login (e-mail address) and password.
When registering, or at a later stage of using the Platform, the Landlord specifies and provides:
First and last name or company name
The name and address of the Property

A new Tenant
Operating costs related to the lease of the Property and their
amount
The method of settling operating costs
Occupancy of the Property
When registering, the Tenant provides their first name, last name, and information on whether they are of legal age. Optionally, at registration or at a later stage, the Tenant may add their avatar.
It is prohibited to share a User's account on the Brokik Platform with third parties.
§ 5 Obligations, Rights, and Representations of the Company
Under the conditions set out in these Terms and Conditions, the Company undertakes to provide the Services specified in the Terms and Conditions to the User with due diligence.
The Company has the right to:
improve the Platform, including simplifying, expanding, and modifying it, as well as changing its functionalities, in particular to adapt it to applicable laws;
conduct tests of new services, processes, or functionalities on the Brokik Platform, or tests concerning changes to existing services, processes, or functionalities on the Brokik Platform. Tests may affect Users' use of the Brokik Platform, including the manner in which Offers are displayed in search results. Tests may only be conducted for the time and to the extent necessary and proportionate to achieve the purpose of the test. The Company conducts tests solely for the purpose of developing the Brokik Platform, adapting to market changes, adapting to changes in the law, or improving the services provided;
provide updates and new versions of the Platform, provided that an update may be necessary for the continued efficient and secure use of the Platform;
interrupt the availability and synchronization of the Platform for the time necessary to properly carry out administrative activities related to the proper securing, archiving, and protection of the data and databases accumulated on the Platform, or related to its update or the technical infrastructure used to operate it;
temporarily block access to a User's Account, if justified by circumstances provided for in these Terms and Conditions, or by the need to clarify doubts related to the User's operation of the Account, in accordance with the Company's obligations under Article 14 of the Act on the Provision of Services by Electronic Means
delete a User's Account on the terms set out in these Terms and Conditions
manage the Platform and its processes and change the Platform for justified reasons, in particular technological, security-related, or resulting from changes in the law; if a change materially and adversely affects the Landlord's access to paid Services, the Company shall give at least 30 days' advance notice of it, and the Landlord may, within that period, terminate the Agreement with a refund of the fee for the unused part of the Billing Period,
amend these Terms and Conditions on the terms set out in § 15.
The Company shall not be liable for:
interference with a User's Account that is not the Company's fault, in particular as a result of force majeure, hacking attacks, or unauthorized persons unrelated to the Company gaining possession of login credentials,
technical problems or technical limitations of the computer equipment used by the User, which prevent the User from using the Services,
the capacity of Users to conclude any contracts.
the Landlord's holding of legal title to the Property.
The Company excludes the rights of a User who is not a consumer against the Company under the statutory warranty (rękojmia) referred to in Article 556 et seq. of the Civil Code.
The Company is not a party to lease agreements, so any disputes related to the lease of a Property should be resolved directly between Users.
The Company does not guarantee that:
the Platform will meet the User's expectations and requirements
access to the Platform will be available uninterrupted, quickly, and without any disruptions or errors.
The provisions of this paragraph and the preceding paragraphs, excluding or limiting the Company's liability, do not apply to Users who are Consumers. Towards a Consumer, the Company is liable on general principles, and the Consumer retains all rights arising from the provisions on the conformity of digital content or a digital service with the contract, in particular the right to demand a price reduction for the period during which the Service was unavailable for reasons attributable to the Company.
§ 6 Rights and Obligations of the User
The User bears full responsibility for their actions and omissions related to the use of the Brokik Platform.
The User undertakes to:
use the Platform in a manner consistent with these Terms and Conditions, good practice, and generally applicable law, including, among other things, respect for the rights of third parties such as personal rights or intellectual property rights, the provisions of the Civil Code, and the provisions of the GDPR,
provide true, correct, accurate, complete, and non-misleading personal data, and, where applicable, also a bank account number, NIP (Tax ID) number, address, telephone number, and company name,
respect the intellectual property rights of the Platform and of other Users,
refrain from any actions that endanger the security of the Platform,
protect their Platform password and login against unauthorized access by third parties.
The User represents that, at the time of registering on the Platform, they provided true information, and undertakes to promptly inform the Company of any changes to their registration data, including, but not limited to, the e-mail address and the current bank account number. Changes may be reported to the Provider by e-mail at support@brokik.com or through the Platform. Until a new address is reported, any statements sent to the previous address shall be deemed duly delivered.
By accepting these Terms and Conditions, the Landlord declares that they have the right to lease the Property and that there are no physical or legal obstacles to leasing the Property.
After completing Registration, the User has the right to:
obtain access to the Services,
communicate with their counterparty – the Tenant or Landlord – through the Platform.
§ 7 Term of the Agreement for the Provision of Services by Electronic Means
The Agreement is concluded for an indefinite period.
The User may terminate the Agreement at any time by going to the "Delete account" tab in Settings
The Company may terminate the Agreement with the User with immediate effect for important reasons, in particular in the event of:
the User's breach of the provisions of these Terms and Conditions and/or the provisions of law,
the User taking actions that endanger the security of the Platform;
the User attempting unauthorized access to the Platform;
the commission, or reasonably suspected commission, by the User of a crime using the Platform
the User's use, or reasonably suspected use, of the Platform in a manner contrary to generally applicable law
the User acting to the detriment of the Company.
The Company may terminate the Agreement with the User subject to a 30-day notice period for the following reasons:
a decision by the Company to discontinue the provision of Services
the User having provided untrue data during Registration,
the issuance against the Company of a final decision or ruling prohibiting the Company from conducting business in respect of the Services,
the entry into force of laws requiring the Company to discontinue its business in respect of the Services or to materially change the conditions of conducting such business,
the entry into force of laws introducing a requirement for the Company to terminate the Agreement.
In the event the Company closes an account, the User will receive notice of its closure (termination of the agreement) and, where possible, the reasons for that decision.
After closure of the account:
the Agreement with the User is terminated, provided that the provisions of these Terms and Conditions continue to apply to the extent and for the time appropriate for the closure of the account and to maintain compliance with applicable law,
the Company may suspend, limit, or terminate the User's access to some or all of the Services or Platform functionalities,
the User is obliged to settle all obligations arising from the Agreement, in particular the Subscription,
if the Agreement was terminated by the Company for reasons not attributable to the User, the Company shall refund the Landlord the fee for the unused part of the paid Billing Period, calculated proportionally to the number of days remaining until its end; the refund is made within 14 days of termination of the Agreement, using the same payment channel. In the event the Agreement is terminated by the Company with immediate effect for reasons attributable to the User, the Company may deduct from the refunded amount the equivalent of the damage actually incurred, but not more than the value of one month's Subscription in the Package chosen by the Landlord; the remaining part of the fee for the unused period shall be refunded,
deletion of the User's data takes place solely on the terms of § 10b; the mere termination of the Agreement does not result in deletion of the Account or the data,
the Company may retain information about the User's account in its database for the purposes of fulfilling legal obligations, including the pursuit of claims, defense against claims, and in other cases provided for by law
A User who is a natural person, and an entrepreneur with consumer rights, may withdraw from the contract for the performance of a Service within 14 days of its conclusion. To do so, a statement of withdrawal must be submitted, a model of which is set out in the appendix to the Consumer Rights Act. To meet the deadline, it is sufficient to send the statement before its expiry to the e-mail address support@brokik.com.
§ 8 Terms and Rules of Using the Platform
While using the Platform, the User is obliged to comply with legal norms and regulations, including those to whose jurisdiction the User is subject.
The structure of the Platform consists of interconnected modules, including in particular document generators, form templates, and a knowledge base on property management and mutual settlements between Landlords and Tenants.
The scope of Services available to a User depends on the type of User and on whether the account is free or paid under the Subscription chosen by the Landlord.
The Platform is used for communication between Users and for collecting, organizing, and processing data entered by Users.
In the event of non-payment of the Subscription for the next Billing Period, the Landlord's Account moves into a state of Restricted Access on the terms and after the expiry of the periods set out in § 10.
The Company is not liable to third parties for damage arising from a User's use of the Service. If third parties assert claims against the Company, the Company shall promptly inform the User of that fact. In such a case, a User who is not a Consumer is obliged to release the Company from liability, reimburse the costs incurred as a result, including penalties paid by the Company, and satisfy third-party claims in the manner provided by law. This obligation does not arise with respect to a User who is a Consumer; a Consumer is liable solely on general principles and within the limits of the damage they caused.
It is prohibited to:
use any software (including exploits, automation software, robots, bots, hacks, "spiders", spyware, scripts, trainers, extraction tools, and other software) in any manner that interacts with the Platform and the Services and affects their correct and undisturbed operation,
take any action aimed at limiting the availability of the Platform,
take actions infringing property copyrights, trademarks, patents, trade secrets, privacy, databases, image rights, and other rights,
use any files or programs containing malicious code, including viruses, spyware, trojan horses, worms, time bombs, deliberately corrupted data, or any other files containing malicious code or that could in any way interfere with or damage the operation of the Platform,
post any content contrary to law, good practice, or infringing the rights of other users. It is prohibited to post, by means of the Platform, any profanity, pornographic, racist, sexist, xenophobic content, content promoting hatred, violence, intolerance based on race, religion, sexual orientation, or gender, and content glorifying totalitarian systems and criminal organizations, infringing the personal rights of, or offending the dignity of, other persons, and moral norms,
take any action to the detriment of the Company or other Users, in particular in the form of hacking, attempts to gain unauthorized access to the Platform's IT systems and/or the accounts of other Users, as well as using the Platform in a manner causing above-average load on servers and/or connections.
It is prohibited to use bots and other IT or software tools (including tools for exploring, collecting, or extracting data), including tools:
that generate or may generate increased traffic on the Brokik Platform, in particular multiplying the number of visits to the Brokik Platform, causing excessive load on IT systems,
that constitute malicious software (including viruses) or that may be used to infect the resources or IT infrastructure of the Brokik Platform with malicious software (including viruses),
used to carry out cyberattacks (including network attacks, in particular DDoS attacks),
during, in connection with, or for the purpose of using the Brokik Platform.
The Company shall not be liable for content placed on the Platform, in particular for the content, completeness, legality, and timeliness of offers made available by Users, and is not obliged to monitor such content or Users' conduct, but reserves the right to remove content that violates these Terms and Conditions or good practice.
The Account login and password are confidential information, and it is not permitted for the User to disclose them to anyone. The User should exercise all due care to properly protect the login and password against access by unauthorized persons, including establishing a password strong enough to prevent it from being easily guessed. The Company shall not be liable for the User's loss of the ability to access their Account (loss of login, password, or other information needed to use the Platform).
In the event of a breach of the rules for using the Platform set out in these Terms and Conditions and in other documents governing the rules of the Platform, or a breach of the law, the Company is entitled, in particular, to:
send the User a warning to the e-mail address provided by them, or via another communication channel provided on the Platform,
block, suspend, or limit the User's access to one or more parts of the Platform or to one or all of that User's Accounts for a fixed period, or
delete the User's account
refuse to provide services to the User in the future.
The Company will notify the User of the suspension of an Account or the limitation of access to specific services via the Brokik Platform or e-mail, indicating the reasons for the suspension or limitation of access to the Account.
The User may appeal against the Company's decision within 14 calendar days of one of the actions referred to in paragraph 7.
After the reason for the blocking, suspension, or limitation of the User ceases, the Company shall unblock access to the Account.
A User whose Account has been suspended or on which functionality restrictions referred to above have been imposed may not register a new Account, or use another Account, without the Company's prior consent.
In the case of conduct which does not constitute a breach of these Terms and Conditions and other documents governing the rules for using the Platform, but which is undesirable, the Company reserves the right to delete the account after having first sent the User the warning referred to in paragraph 7(a) above, and the User's failure to cease the breaches.
The Company has the right to remove content that infringes the law or these Terms and Conditions, or that it deems inappropriate due to the security of the operation and use of the Platform and the possibility of infringing the rights of third parties.
§ 9 Properties
In order to add a new Property in the "My Properties" tab, the Landlord completes the form available on the Brokik Platform, in which they must in particular include the name and description of the Property and, if applicable, its photographs.
Any liability of the Company arising from Property listings posted on the Brokik Platform is excluded.
It is prohibited to include in the description of a Property content that violates the law, these Terms and Conditions, or words, expressions, or phrases used contrary to standards of decency.
The functionalities of the Platform enable the Generation of Documents related to the Lease, facilitating the management of the Property.
Data and information entered by the User remain the User's property. The Company uses them only to the extent necessary to provide the Services to the User, to maintain them, to ensure security, and to fulfil legal obligations, and, with regard to personal data, solely on the documented instructions of the User, on the terms of the data processing agreement. The Company may use data in aggregate and anonymized form, which does not allow identification of the User, the Tenant, or the Property, in order to develop and improve the Platform.
The Platform enables Generated Documents to be provided with an electronic signature. The signature is submitted remotely, after verification of the signatory's identity by means of a one-time code (OTP) sent to their e-mail address. A signature made in this way constitutes an electronic signature within the meaning of the eIDAS Regulation (a simple electronic signature).
In connection with the submission of an electronic signature, the Company records and stores the data necessary to confirm the authenticity and integrity of the document, including: the signatory's first and last name and e-mail address, their role in the signing process, the date and time the signature was made, the IP address, and browser information, as well as a record of the events of the signing process (audit trail). The OTP code is stored only in encrypted form and expires after 10 minutes.
The submission of an electronic signature is voluntary. An invitation to sign (signing session) is valid for 7 days. Detailed information on the processing of data in connection with the electronic signature is contained in the Privacy Policy.
§ 10 Payments
Management of a Property lease by the Landlord requires the purchase of a Subscription in accordance with the Price List. The Subscription is payable in advance for the selected Billing Period: monthly, annual, or two-year. The number of Properties covered by a given Package and the amount of the Subscription for each Billing Period result from the Price List.
The Landlord may cancel the Subscription at any time by independently disabling automatic renewal in the User Panel; cancellation does not require contacting the Company or observing a notice period. Cancellation takes effect at the end of the paid Billing Period – until that date the Landlord retains full access to the paid Services, and the Company does not collect a further fee. The Landlord may also cancel by sending a message to support@brokik.com. If the Landlord paid for the Subscription by a method other than a payment card, the Subscription does not renew automatically and cancellation requires no action — it is sufficient not to pay for the next Billing Period.
The Subscription renews automatically for the next Billing Period of the same length, unless the Landlord disables renewal before its end. For an annual Billing Period, the Landlord may withdraw from the renewal within 30 days of the date of the charge, without giving a reason; the Company then refunds the full amount collected within 14 days, and the Account moves into a state of Restricted Access at the end of the previously paid Billing Period. Automatic renewal applies only to payments by payment card; for other payment methods, the next Billing Period requires payment by the Landlord. The Company informs the Landlord of the upcoming automatic renewal, the charge date, and the amount by e-mail at least 7 days in advance — and, if the renewal amount is higher than the amount for the previous Billing Period, at least 30 days in advance. For an annual Billing Period, the notice period is at least 30 days. The message contains information on how to disable automatic renewal and a direct link to that function in the User Panel. The above rules on automatic renewal do not apply to the two-year Billing Period — the two-year Subscription is a one-time purchase without automatic renewal, because the Company's billing systems do not support recurring charges for periods longer than one year.
In the event of a failed payment card charge, the Company retries collecting the fee and informs the Landlord of this by e-mail. Until the Subscription is successfully paid, but for no longer than 14 days from the end of the paid Billing Period, the Services remain available unchanged. After the unsuccessful expiry of this period, the Account moves into a state of Restricted Access.
Without payment of the Subscription, and also after the end of a paid Billing Period without payment of the Subscription for the next Billing Period, the Landlord's Account is in a state of Restricted Access. In this state, the Landlord retains — for an unlimited period, subject to § 10b — access to the Account, a view of all of its data and documents, the ability to download them and export all data, as well as access to the payment screen. Maintaining Restricted Access requires logging into the Account at least once every 12 months; the Company reminds the Landlord of this by e-mail before the expiry of this period, in accordance with § 10b. The following remain disabled: adding and editing Properties, entering into new agreements and initiating electronic signatures, drawing up protocols, requests for meter readings, recording payments, reports, and automatic notifications sent on behalf of the Landlord.
Despite being in Restricted Access, the Landlord retains the ability to complete the handover protocol and the final settlement of a lease, including the settlement of the deposit, for leases in the process of ending. The Tenant's rights remain unaffected: all links issued to them, signing sessions, and access to their Account continue to work unchanged, and all documents and settlements relating to their lease remain accessible to them. Only the sending of automatic reminders generated on behalf of the Landlord is suspended; the Tenant retains a view of the deadlines and amounts in their Panel.
The Company does not delete the Landlord's data due to non-payment of the Subscription. The Landlord may at any time download a complete set of their data as an archive file, including while in a state of Restricted Access. Deletion of the Account occurs solely at the User's request or in the case specified in § 10b.
Payment is made through the operator of the service handling electronic payments, including by bank transfer, BLIK, or payment card.
The Landlord has the ability to generate an electronic VAT invoice on the User Account. The Landlord consents to receiving the invoice by electronic means.
The Company makes the VAT invoice for the paid Subscription available on the User Account once the payment has been booked.
In relations with Users who are not consumers within the meaning of the Civil Code, the Company reserves the right to change the amount of the fees set out in the Agreement (including in the Price List) on the basis of which fees are calculated, or to introduce new fees, at any time.
The Company may change the amount of the Subscription fees for a Landlord who is a Consumer only for important reasons, which the Parties consider to include at least one of the following reasons:
a change in the annual consumer price index announced by the Central Statistical Office (GUS) of at least 1 percentage point compared to the index announced by the Central Statistical Office for the corresponding period of the previous year, if that change occurred no later than 6 months before the Company's change to the amount of the given fee. An increase in the fee on this basis may occur only once in a calendar year. This condition does not apply to fees that are indexed under the Price List in accordance with the consumer price index,
the introduction of new services or products, provided that the change in the amount of the fee will apply only to those new services or products, that using them will not be mandatory for the User, and that not using them will not entail costs for the User,
a change in the scope of the provision of existing services or products, which results in a change in the costs of providing those services or products
The Company shall inform each Landlord of a change in the Subscription fees by e-mail, sent to the Landlord's e-mail address, at least 14 days before the introduction of the planned change.
The changed fees shall bind the Landlord from the date specified by the Company, unless the Landlord, within 30 days of the date the notice of the changed fees was given, terminates the Agreement or disables automatic renewal in the User Panel. Disabling automatic renewal is equivalent to withholding consent to the changed fees and does not result in the Landlord being charged the changed fee. If the Landlord does not exercise either of these rights, it is deemed that they consent to the changes. A termination submitted under this paragraph takes effect at the end of the current Billing Period, and if the charge for the next Period has already occurred — the Company shall refund the entire amount collected within 14 days. The termination notice should be sent to the e-mail address support@brokik.com or in writing to the Company's registered office address. A change of fees on the terms set out in this paragraph does not require an annex to the Agreement
§ 10a Refund Guarantee and Transitional Provisions
A Consumer and an entrepreneur with consumer rights who has entered into a contract for a paid Subscription may withdraw from it without giving a reason within 14 days of its conclusion, by submitting a statement — including on the form constituting Appendix No. 2 to the Act of 30 May 2014 on Consumer Rights — to support@brokik.com. To meet the deadline, it is sufficient to send the statement before its expiry.
By purchasing a Subscription, the Landlord requests that the provision of paid Services begin before the expiry of the withdrawal period, and acknowledges that, in the event of withdrawal after the commencement of provision, they will pay for the performance rendered up to the moment of withdrawal — in an amount proportional to the scope of performance rendered up to that moment, calculated according to the Subscription price indicated in the Price List for the selected Billing Period. The Landlord makes this request by ticking a separate statement in the purchase process; the Company confirms it on a durable medium together with confirmation of the conclusion of the contract.
The Company shall refund the remaining part of the fee promptly, no later than within 14 days of receiving the statement of withdrawal, using the same method of payment.
Regardless of the above, the Landlord is entitled to a contractual refund guarantee: the right to a refund of the fee for the first Subscription purchased, if they submit such a request within 30 days of the date it was paid. The guarantee is more favorable than the statutory right — the Company refunds the entire amount paid without deductions, within 14 days of the request, using the same payment channel. The Landlord submits the refund request in the User Panel or to support@brokik.com. Upon the refund being made, the Agreement for the provision of paid services is terminated, and the Account moves into a state of Restricted Access (§ 10). This right applies once per Account, regardless of the Landlord's status as a Consumer, and does not deprive them of the statutory right of withdrawal.
A change to the Price List does not affect Billing Periods already paid for. New rates apply only to purchases and renewals made after their entry into force, and the Company informs the Landlord of a rate change prior to automatic renewal with the advance notice indicated in § 10.
Landlords for whom, on the date these Terms and Conditions enter into force, a 45-day Trial Period granted under the Terms and Conditions of 31.08.2026 is ongoing shall retain it until the originally scheduled day of its end. An extension of this period is no longer available. After its expiry, the Account moves into a state of Restricted Access (§ 10), unless the Landlord purchases a Subscription in accordance with the Price List; the data entered remains available for reading, downloading, and export.
§ 10b Inactive Accounts
If a User does not log into their Account for a period of 12 consecutive months, the Company sends to their e-mail address a notice of its intention to delete the Account together with the data accumulated, indicating the day on which the deletion will take place. The provisions of this paragraph do not apply to an Account for which, during that period: (a) a paid Billing Period was ongoing, (b) an ongoing lease or an unsettled deposit was registered on the Platform, or (c) a complaint procedure or a dispute involving the User was pending. In these cases, the running of the 12-month period begins on the day the relevant circumstance ceases.
Deletion takes place 30 days after the sending of the notice referred to in the preceding paragraph. The Company repeats this notice no later than 7 days before deletion. Logging into the Account before the expiry of this period cancels the deletion, and the running of the 12-month period begins anew.
The notice referred to in paragraph 1 also contains a link enabling the User to delete the Account together with the data earlier, without waiting for the expiry of the period. Clicking the link does not result in the deletion of the data — it opens a page on which the User confirms the deletion request. The link remains valid for 7 days. Before confirmation, the Company enables the User to download a complete set of their data as an archive file.
Deletion of the Account is irreversible and covers the User's data stored on the Platform, with the exception of: (a) data whose further storage is required by law, in particular accounting and settlement documentation — for the period resulting from those provisions, and (b) data necessary to establish, pursue, or defend against claims — for the period of their limitation. Detailed retention periods are set out in the Privacy Policy.
§ 11 Intellectual Property Rights
The Company is the owner of the intellectual property rights to the Platform, in particular the software, source code, graphics, user interface, databases, visual components, artistic design, designs, objects, sound effects, audio and video clips, texts, and any other content, and other rights and entitlements to exploitation provided for by law. By using the Services offered by the Company, the User does not acquire any copyright to any content/materials, in particular the software.
For the duration of this Agreement, the Company grants the User a limited, revocable, non-exclusive, and non-transferable license to display, view, download, run, and use the Brokik Platform on a personal computer or other mobile device.
The Platform may contain certain licensed materials, and in such a case the Company's licensors may exercise protection of their rights should any breach of these Terms and Conditions occur. Any copying or presentation of such licensed materials by any technique for any purpose is prohibited without obtaining the prior consent of the Company and, where applicable, the consent of the licensors and representatives of the Company.
The User may not in any way adapt, copy, modify, reproduce, store, distribute, display, publicly perform, publish, transmit, sell, rent, lease, or license the content of the Service or any part of it without the express written consent of the Company.
The User may not translate, reverse-engineer, modify, create derivative works from, or otherwise modify the Platform.
The User may not remove, alter, disable, or circumvent any copyright and trademark notices or other information about authorship and origin, notices, or labels found on or within the Platform.
The User may not bypass the security system or in any way interfere with the Services or the Platform, nor attempt to make any changes to the Software or any features or components of the Service or Platform.
All rights to the Platform and the Services, and trademarks and trade names belonging to the Company, are reserved, with the exceptions set out in the Agreement.
Upon entering into the Platform information, photographs, and other content constituting the subject matter of copyright protection, in particular signs, logos, images, descriptions, and photographs ("Content"), the User grants the Company a free of charge, non-exclusive license, unlimited in time and territory, to use such Content to the following extent:
recording and reproduction by any technique, including by making recordings and copies on any type of paper, electronic, magnetic, or optical media;
dissemination via telecommunications networks (including the Internet and GSM networks) in any manner and using any technology, in particular by: disseminating it in such a way that anyone can access the Content at a place and time of their own choosing, and other forms of exploitation in telecommunications networks regardless of any applicable means of restricting access; public display and playback, including by means of mechanisms for the automatic playback of Content on websites;
public performance, exhibition, display, playback, and broadcasting and rebroadcasting
lending and putting into circulation.
The User's consent also covers the creation of derivative works of the Content by the Company and the use of such derivative works to the extent to which the Company is entitled to use the Content, and the granting of further consents to the extent corresponding to the consent granted to the Company.
The User consents to the exercise of the moral rights to the Content by the Company and declares that they will not exercise those rights against the Company or entities to which the Company grants further consents to use the Content.
The Provider authorizes the Company to translate the Offer and its elements (including by means of software for automatic text translation) into other languages, and also to display it in other languages.
The User grants the Company permission to use the Services performed (understood as the performance of this Agreement) for the purpose of promoting the services provided by the Company, in particular to:
present the Services in the Company's portfolio and present the Services to the Company's clients,
indicate in its portfolio/website the fact of cooperation between the Parties, the nature and scope of that cooperation, and list and describe the Services provided by the Company under the Agreement
For the purpose of promoting the services provided by the Company, the User grants the Company a non-exclusive, free of charge license, unlimited in time and territory, to use the name, logo, and content posted on the Platform by the User, in the following fields of exploitation:
recording and reproduction in the form of copies by any technique, in particular printing, reprographic, magnetic, optical, and digital recording, on any media,
recording and reproduction in digital form, in particular within ICT systems,
dissemination through public exhibition, display, playback, and broadcasting and rebroadcasting, including within the framework of internet television and radio, transmission by e-mail, and public availability in such a way that anyone can access it at a place and time of their own choosing, including on the Internet, mobile telephony networks, and other electronic communication networks, and dissemination by e-mail,
use through incorporation into other works, including within an audiovisual work.
§ 12a Conformity of the Service with the Contract
The Company provides a Service that conforms with the contract. Conformity is assessed in particular according to the description, type, quantity, quality, completeness, functionality, compatibility, and interoperability of the Service, as well as according to fitness for the purpose which the Consumer informed the Company of no later than at the time of concluding the contract.
The Service is provided continuously throughout the entire paid Billing Period. The Company is liable for a lack of conformity of the Service with the contract that occurred and became apparent during that time.
The Company informs the Consumer about updates, including those relating to security, necessary to maintain the conformity of the Service with the contract, and provides them for the duration of the contract.
If the Service is not in conformity with the contract, the Consumer may demand that it be brought into conformity. The Company shall do so within a reasonable time from the moment it is informed of the lack of conformity and without undue inconvenience to the Consumer, bearing the costs related thereto.
The Consumer may submit a statement on price reduction or on withdrawal from the contract when: the Company refused to bring the Service into conformity with the contract or did not bring it into conformity, the lack of conformity persists despite the attempt to remedy it, the lack of conformity is significant enough to justify an immediate price reduction or withdrawal, or it is clear from the circumstances that the Company will not bring the Service into conformity within a reasonable time or without undue inconvenience.
The reduced price remains in such proportion to the price under the contract as the non-conforming Service bears to the conforming Service. For the period during which the Service was unavailable for reasons attributable to the Company, the Consumer is entitled to a price reduction proportional to the length of that period.
The Company shall refund the Consumer the amounts due promptly, no later than within 14 days of the date of receiving the statement on price reduction or on withdrawal from the contract, using the same method of payment.
The provisions of this paragraph apply to Consumers and to entrepreneurs with consumer rights and do not limit their rights arising from mandatory provisions of law, in particular from Chapter 5b of the Act of 30 May 2014 on Consumer Rights.
§ 12 Complaints
A User may lodge a complaint if a Service provided for in these Terms and Conditions is not being performed by the Company or is being performed improperly, contrary to the provisions of these Terms and Conditions. A User may also lodge a complaint concerning incorrect charging of the User's fees directly to the Company.
Any complaints and reservations related to the functioning of the Platform should be addressed in
writing to the Company's address – WebET Sp. z o.o., ul. 1 Maja 30A, 45-355 Opole, Poland,
electronic form to support@brokik.com
A complaint should contain a description of the problem underlying the complaint and its justification.
A complaint related to a lack of payment made through an electronic payment operator should contain the User's details, their e-mail address, information on the date and time the payment was made, and the method and type of that payment.
A response to the complaint is sent to the User's e-mail address.
Complaints will be examined promptly, in the order they are received, but no later than within 14 days of their receipt.
If a complaint does not contain the information necessary for its examination, the Company will ask the User submitting the complaint to supplement it to the necessary extent, and the 14-day period then runs from the day the supplemented complaint is delivered.
A User who is a natural person has the right to use out-of-court methods of dispute resolution, including through
applying to the standing amicable consumer court with a request to resolve a dispute arising from the concluded contract (more information at: http://www.spsk.wiih.org.pl/),
using the assistance of the county (municipal) consumer ombudsman or a social organization whose statutory tasks include consumer protection (more information: https://www.uokik.gov.pl/rzecznicy.php).
using other methods of handling complaints and pursuing claims, which the User can look for on the website www.uokik.gov.pl under the "consumer dispute resolution" tab.
§ 13 Information on Specific Risks Related to
the Use of Services Provided by Electronic Means
The Company informs that the use of services provided by electronic means may involve potential risks related to the use of services provided by electronic means. The basic risks include, among others:
spam – receiving unsolicited commercial information by electronic means;
malware – various types of applications or scripts having a harmful, criminal, or malicious effect on a network user's ICT system, such as viruses, worms, and trojans;
spyware – programs that track a user's activities, which collect information about the user and send it – usually without their knowledge and consent – to the author of the program;
phishing – the fraudulent extraction of confidential personal information, such as passwords;
unauthorized eavesdropping (sniffing) – the use of computer software whose task is to intercept and potentially analyze data flowing through a network;
break-ins into a user's ICT system using hacking tools;
cryptanalysis, i.e. finding the weaknesses of a cryptographic system and enabling it to be bypassed or broken.
The Company takes the necessary steps aimed at minimizing the risk of the threats referred to in paragraph 1 above occurring, as well as steps to increase the security of using the Platform.
Irrespective of the steps taken by the Company referred to in paragraph 2 above, in order to significantly reduce the risk of the threats referred to in paragraph 1 above occurring, the User should have a strong password and login for the Platform and equip their computer and other electronic devices which they use to connect to the Internet with antivirus software and a firewall, and keep them constantly updated.
The Company exercises due diligence to remove any faults, errors, and irregularities of the Platform. Users are obliged to notify the Company at support@brokik.com of any errors, faults, and irregularities in the operation of the Platform that they notice.
§ 14 Personal Data
WebET Sp. z o.o. with its registered office in Opole, ul. 1 Maja 30A, 45-355 Opole, Poland, entered in the Register of Entrepreneurs of the National Court Register under KRS number 0000940072, NIP (Tax ID) 7543346806, REGON 52071749700000, is the controller of Users' personal data to the extent necessary for the registration and administration of the User's account (outside the scope of Users' management of leases, including settlements made between Users using the Platform) and within the scope of the business relationship between the Company and the User. The Company processes the personal data of Users' representatives (owners, board members, employees using the Brokik Platform). A User that is an institutional Landlord — a personal data controller — shall make available the information clause on the processing of the personal data of its counterparties, appropriate in connection with the use of the Platform. Detailed information on the processing of personal data can be found in the Privacy Policy document.
The Company is a processor with respect to Users as regards the operation of the part of the Brokik Platform made available to Users, correspondence, and other activities carried out using the Brokik Platform between Users.
Providing registration data is voluntary, although necessary for the proper registration and creation of an Account.
The User is obliged to provide true data wherever it is required, and to update the data provided in the registration form promptly after each change to that data.
Users who are personal data controllers are obliged to process the personal data made available in connection with the other Parties' use of the Platform in a manner ensuring the security of the personal data processed and in accordance with applicable data protection law, in particular the GDPR, including ensuring the application of organizational, technical, and IT measures adequate and consistent with the current state of knowledge in order to secure their own IT and telecommunications infrastructure cooperating with the Platform, and admitting to processing only authorized persons who have been bound to confidentiality.
All Users are obliged to ensure the security of data processing while using the Platform and not to disclose it to unauthorized persons or for purposes unrelated to the performance of the Property lease. Unless they have obtained the express, separate consent of the data subject, Users may not use the personal data of the Company's employees, associates, or subcontractors, or of other Users, which they received via the Platform, for purposes other than using the Platform and conducting the administration of the lease and settlements between the Parties to the lease. In particular, it is prohibited to sell or transfer such data to other personal data controllers and to use it for the purposes of one's own marketing or that of third parties, opening accounts in online shops, and entering into transactions outside the Platform.
Users' personal data may be transferred solely for the purpose of operating the Platform, pursuing the Company's legal interest, and fulfilling the Company's legal obligations:
to entities providing IT services necessary for the functioning of the Platform;
to entities providing legal services for the Company;
to entities authorized to receive it under applicable law, including the relevant tax authorities and judicial authorities.
Users' personal data and data entrusted by Users will be processed for the duration of the use of the User Account, extended by the time resulting from the need for the Company to fulfil the obligations imposed on it by law, in particular tax law, telecommunications law, the law on the provision of services by electronic means, consumer law, and for the time necessary to pursue claims or defend against claims.
In matters not regulated in this section, the provisions of Appendix No. 2 to the Terms and Conditions (Privacy Policy) apply accordingly.
If the performance of the Agreement involves the Company accessing personal data for which the User is the Controller within the meaning of the GDPR, the User and the Company shall enter into a data processing agreement in accordance with the requirements of Article 28 of the GDPR. This agreement shall be consistent with the template set out in Appendix No. 3 to these Terms and Conditions. The Company sends the template free of charge before the conclusion of the data processing agreement, at the request submitted to support@brokik.com, within 7 days of the request. Concluding the data processing agreement is necessary to use Services that require the User to entrust personal data to the Company.
With respect to Users using the Platform solely for personal or household purposes, the provisions of the GDPR do not apply, provided that the scale and scope of their activity does not exceed such ordinary personal or household use, e.g. they do not conduct leasing on a larger scale of a nature similar to business activity. In such a case, the User benefits from the exclusion from the GDPR and is exempt from the obligation to conclude a data processing agreement, but remains responsible for protecting the personal data of other Users that they process in connection with the use of their User Account. If the scale of a User's activity indicates that it exceeds ordinary personal or household use, the User becomes a Controller of personal data and will be obliged to sign a data processing agreement. The User is responsible for determining whether they may benefit from the exclusion from the application of the GDPR.
§ 15 Amendments to the Terms and Conditions
The Provider reserves the right to amend these Terms and Conditions for important reasons, in particular:
a change in the technical conditions for the provision of services by electronic means by the Provider, including the introduction of new services, the expansion or modification of the Platform's functionalities,
a change in the conditions or process of concluding a contract for the provision of services by electronic means by the Company
a change in the provisions of generally applicable law affecting the content of these Terms and Conditions, or due to a provision of these Terms and Conditions being found impermissible – accordingly to that extent;
improvement of User service, including counteracting abuse,
improvement of the protection of Users' privacy,
security considerations
technological and functional changes
the need to remove any errors, typographical mistakes, or
ambiguities from the content of these Terms and Conditions,
changes to the Price List,
changes to the Privacy Policy
a change in the Company's details, in particular names, identification numbers, electronic addresses, links posted, or contact details indicated in these Terms and Conditions
to fulfil an obligation resulting from a final court judgment or an administrative decision;
if the change is necessary due to a change in the way the services are provided.
The Company will notify the User of every amendment to these Terms and Conditions by sending a message to the e-mail address provided at registration, or by other means of communication provided on the Platform. The Company will inform the User of their right to terminate the Agreement within 14 days, following the procedure for terminating the Agreement indicated in § 7 of these Terms and Conditions. Amendments to the Terms and Conditions enter into force upon the expiry of the period for terminating the Agreement. Failure to accept the amended Terms and Conditions is equivalent to termination of the Agreement for the provision of paid services upon the expiry of the paid Billing Period. The User's Account is not deleted — it moves into a state of Restricted Access (§ 10), in which the User retains access to read their data, download documents, and export all data. Deletion of the Account occurs solely at the User's request or in the case specified in § 10b.
The Company provides access to archived versions of the Terms and Conditions — the Company sends them free of charge at the request submitted to support@brokik.com, within 7 days of the request.
These Terms and Conditions are effective as of 14.09.2026 and replace the Terms and Conditions of 31.08.2026. Date of last update: 14.09.2026.
§ 16 Final Provisions
The User bears sole responsibility for using the Platform within the territory of their State in accordance with the laws applicable there.
The provision of Services under this Platform is governed by Polish law.
Any disputes between the Company and a User who is not a consumer, concerning the Company, including those related to services provided by the Company through the Platform, shall be resolved, on a non-exclusive basis, by the Polish common courts having jurisdiction over the Company's registered office.
In the case of Users who are consumers, the above choice of law does not exclude the protection afforded to Users under the mandatory provisions of the law of the state in which the User who is a consumer has their habitual residence.
A User who is a consumer has the possibility of using out-of-court methods of pursuing claims and handling complaints. The rules for accessing these procedures are available at the offices or websites of the entities authorized to handle out-of-court dispute resolution. These may in particular include consumer ombudsmen or Provincial Trade Inspectorates. Information on how to access the above mode and dispute resolution procedures can be found at the following address: http://www.uokik.gov.pl, under the "Consumer Dispute Resolution" tab. A User who is a consumer may also apply to the county (municipal) consumer ombudsman or to the provincial inspector of Trade Inspection. The Company is furthermore ready to resolve a dispute amicably — simply send a message to support@brokik.com.
If any provision of these Terms and Conditions is deemed invalid by a final court judgment, the remaining provisions shall remain in force, unless the applicable law provides for a different effect.
The original language of these Terms and Conditions, the website, and all communication of the Company with Users is Polish. Should any other language versions of these Terms and Conditions arise, they should be resolved by reference to the original language version, except where mandatory provisions of law require them to be resolved on the basis of a different language version.
The Appendices form an integral part of these Terms and Conditions, namely:
